On April 4, 2010, John Patrick Barton was charged with murder after the vehicle he was driving crashed into the sedan of an Argyle family near Lewisville on Interstate 35E near State Highway 121. Mr. Barton had been charged with driving while intoxicated on three other occasions. Mr. Barton was allegedly intoxicated at the time of the accident. Unfortunately, the sedan's driver and 13-year old daughter died as a result of the accident. Three other passengers remained hospitalized at the time of this posting. Initially, Mr. Barton was charged with intoxication manslaughter, but the charges were upgraded to murder based on his DWI convictions.
Numerous individuals are injured or killed annually in Texas as a result of drunk driving accidents. In many cases, the restaurants or bars that were responsible for over-serving the drunk driver have been held liable for the injury or death of a motorist who is involved in an accident with the drunk driver.
