Q: Can the child support amount be modified after the divorce in Texas?

A: The amount of a child support payment may be modified in certain circumstances. The simplest method is for the parents to reach a mutual agreement about the support amount, but the court must still approve the change for it to be enforceable.

When the parents cannot mutually agree to the modified support amount, the parent seeking the modification must request a court hearing at which both parents will present evidence supporting the reasons supporting and opposing the modification. Ordinarily, the court will not grant the request unless there has been a significant change in the circumstances of the parents that justifies the change, such as a significant increase in income as a result of remarriage, an employment change or a significant change in the needs of the child(ren).
