A: A divorce is a lawsuit filed by one spouse against the other asking the Court to dissolve the marriage. The complexity of the divorce process usually depends on the extent to which the spouses have reached agreements regarding property division and custody of any children. The spouse seeking a divorce starts the process by filing an Original Petition for Divorce expressing the spouse's desire to dissolve the marriage. The other spouse may either waive service of the Original Petition for Divorce and later sign an agreed Final Decree of Divorce, or he or she may answer the Original Petition by filing an Original Answer or Original Answer and Counter-Petition for Divorce. Particular counties in Texas may have special rules for the form and contents of these documents.
