Q: Is fault on the part of one spouse required to obtain a divorce in Texas?
A: No. Texas is a "no-fault" divorce state. The spouse seeking a divorce does not have to obtain the consent of the other spouse to obtain a divorce or prove that the other spouse is at fault in some way. The divorce will ultimately be granted assuming the appropriate documents are filed with the Court, and subject to the terms of the parties' agreements regarding property division and custody of the children, if any.
