Q: What is an uncontested divorce in Texas?
A: When the parties plan on resolving all of the issues relevant to a divorce without significant court or lawyer involvement, the divorce is considered uncontested or agreed. In this situation, the attorney's role is usually limited to preparing and filing the Original Petition for Divorce, the Final Decree of Divorce, and other documents necessary to finalize the divorce. If the parties are in agreement regarding the division of their property and custody of the children, if any, proceeding with an uncontested divorce is the best and least expensive alternative.
