Q: Where should I file for divorce in Texas?
A: A divorce suit may only be filed in a Texas court if one of the spouses has been domiciled in Texas for the preceding six-month period. To file a divorce suit in a particular county, one spouse must be a resident of that county for the preceding 90-day period. If one spouse has been a living in Texas for at least the last six months, a spouse living in another state may file a suit for divorce in the county in which the Texas spouse resides at the time the petition is filed.
